Raila Odinga has withdrawn from the October 26 presidential race and demanded that IEBC calls a fresh election.

The decision is in Kenya's interest and is "a win-win for everyone", the NASA leader said on Tuesday.

The former Prime Minister said it is only through his withdrawal that the country will have a free and fair election as per the law.

But IEBC told The Star the Opposition leader's withdrawal had already been overtaken by time as he was to do it within three days of being gazetted.

It also comes a day after President Uhuru Kenyatta dared the ODM leader to quit the race and allow the country to move on.

However, Raila says that in 2013, the Supreme Court expanded the meaning of Article 138(8) (b) to include withdrawal of a presidential candidate.

"The Supreme Court clarified that the relevant article is 138 (8) (b) which deals with cancellation of a presidential election, in the event of the death of the president or the deputy, on or before the scheduled date. The Supreme Court expanded the clause to include when a candidate withdraws from the presidential election," Raila said.

"The implication of this provision is that upon our withdrawal, the election scheduled for October 26 stands cancelled."

Raila said his withdrawal requires the commission chaired by Wafula Chebukati to conduct fresh nominations as provided for in Elections Act 2011, Section 13 (1).

The provision states: "A political party shall nominate its candidates for an election under this act at least ninety days before a general election under this Act in accordance with its constitution rules."

Fresh nominations will allow other candidates, such as Thirdway Alliance leader Ekuru Aukot, to join the race

Then Uhuru will be declared as president . Only way elections can be stopped is if Raila decides to kill himself , which i'm sure he won't take that path . The court ordered for a new election between Raila and Uhuru , can Raila decide to hand the baton over to someone else ? Will that be allowed ? Won't that be against the court order ? Won't that need another court case ?

IEBC to declare President Uhuru reelected and we be sworn in. Jubilee continue to govern.

RAT knew he was going to get a massive beating on 26th. The defections were gaining momentum daily. He would have been lucky to get 3 million votes.

Good riddance to bad trash.

Procedure at presidential election. 138.

(1) If only one candidate for President is nominated, that candidate shall be declared elected.

(2) If two or more candidates for President are nominated, an election shall be held in each constituency.

(3) In a presidential election—

(a) all persons registered as voters for the purposes of parliamentary elections are entitled to vote;

(b) the poll shall be taken by secret ballot on the day specified in Article 101 (1) at the time, in the places and in the manner prescribed under an Act of Parliament; and

(c) after counting the votes in the polling stations, the Independent Electoral and Boundaries Commission shall tally and verify the count and declare the result.

(4) A candidate shall be declared elected as President if the candidate receives—

(a) more than half of all the votes cast in the election; and

(b) at least twenty-five per cent of the votes cast in each of more than half of the counties.

(5) If no candidate is elected, a fresh election shall be held within thirty days after the previous election and in that fresh election the only candidates shall be—

(a) the candidate, or the candidates, who received the greatest number of votes; and

(b) the candidate, or the candidates, who received the second greatest number of votes.

(6) If more than one candidate receives the greatest number of votes, clause (5) (b) shall not apply and the only candidates in the fresh election shall be those contemplated in clause (5) (a).

(7) The candidate who receives the most votes in the fresh election shall be declared elected as President.

(8) A presidential election shall be cancelled and a new election held if—

(a) no person has been nominated as a candidate before the expiry of the period set for the delivery of nominations;

(b) a candidate for election as President or Deputy President dies on or before the scheduled election date; or

(c) a candidate who would have been entitled to be declared elected as President, dies before being declared elected as President.

(9) A new presidential election under clause (8) shall be held within sixty days after the date set for the previous presidential election.

(10) Within seven days after the presidential election, the chairperson of the Independent Electoral and Boundaries Commission shall—

(a) declare the result of the election; and

(b) deliver a written notification of the result to the Chief Justice and the incumbent President
