Divorce Cases and Business

Has anyone heard of a divorce case in Kenya where the Man is supposed to divide the Shares in his Company or it is only the Matrimonial House that are divided?

hehe kila mtu akule kwake.

Sorry, it doesn’t happen in Kenya.

matrimonial property is ALL property that the man and woman acquired TOGETHER whilst the marriage subsisted [even though you all know women make zero contribution towards the acquisition of property in a marriage, entitled lil’ shits! :D:D]

There needs to be no decided case on the issue if the letter of the law is clear. The legal definition of matrimonial property envisions or encompasses all manner of property [so long as it was acquired by the man and woman together during the course of the marriage], not just the matrimonial home.

Oh, and in kenya, divorce proceedings are quite separate from proceedings for the division of matrimonial property. So there isn’t a divorce cause where the identification or division of matrimonial property arises. You must institute separate proceedings for that.

Unataka kucheza bwanako? This is Kenya, that doesnt happen

Wanaume should now become clever. Register the matrimonial house under a Limited Liability Company. Wanawake wamezoea.

This days women are marrying, studying Marriage Act and the related Jurisprudence so as to become Rich. Professional Gold Diggers. They do not perform in School, with the explicit knowledge of the family members, that the school girls want a rich man to give them a job. Not to study and get a job.

I have tried all my life! But my mother also taught me to use R instead of L.

Because I know umesoma, have you bought land using a LTD so that bibi ajue hajui! Ama you bought the House together!

if the wife contributed non-materially to the business she is also entitled to the assets in the husbands name . non materially like managing thebusiness, supervising construction of flats, taking care of children etc

women know your rights musikubali kunyanyaswa na kina @dingoo_wa_ingoo :D:D

Why would you have your wife supervise construction of ur flats

Huku khupipi anapewa hot slaps akikataa kureform aende zake.

How will putting it under a LTD help if you are the director of the said LTD.

Si kunguru itasema tu that is part of the matrimonial property na anataka 50% yake

With the Act coming into force in 2014 it is a slippery road. Sooner or later the CJ will have to create a separate court division to handle the many cases that are about to come knocking. Advice is ficha Mali if you can otherwise anything you acquire while married to the kunguru might be shared equally.

Kenyan divorce cases are never serious. The couples file for divorce after 3 months they meet in a hotel, chew each other and the case ends like that. Divorce case wachia wazunugu

But it’s the matrimonial house (matrimony means union). So it doesn’t matter in whose name the title is. Ruling will be made according to contribution.
Shares of a company will also be divided according to contribution to those shares, while in the marriage.
Theres really no way of escaping the law.

There is. If you don’t marry.

WHY GET MARRIED IN THE FIRST PLACE?

Si izo mental gymnastics za kutaka kuoa na bado kujiprotect financially ndio usigeuziwe si ni mingi. Ikifika hapa utaenjoy ndoa kweli?

A limited liability company is an independent entity in law. Your claim to the company’s assets are limited to the extent of the percentage shareholding you own in the company, as specified in the memorandum and articles of association.
Big question, what percentage of the company do you own?
By the way, this is a good lesson to our young men. Hold your assets in a LTD liability company. Give ‘le wife’ 3 per cent ownership and hide those documents. It will save you tears some day.
