How do they test for mental fitness to stand for murder trial?

Wacha wamalize kugoogle na kuwatch documentaries za mental health

they want to know if u were in sober mind wen you committed the crime. ikikuja kwa kesi za kuinherit mali ya mwendazake all billionaires are said “he was not in good mental state wen he wrote the will.”

The question is ‘Are you fit to stand trial’ not whether you were mentally unstable when committing the crime.

May be they have instruments za kupima kichwa.

In short, if Marife cares about what will happen to her then she is sane but if she doesn’t care then she will be judged insane in which case she will be sentenced and held in jail at the President’s pleasure…it is a Catch-22 situation.

the psychological techniques that he uses in that book are mind boggling

If the accused has the presence of mind to

a)know that theyre in a courtroom, why they are there, who the people in courtroom are,what the pple in the courtroom are there for as in their roles in the trial - like the judge,the accused’s counsel.

b)To understand the crime they have been charged with, the pleas available for them to take i.e. guilty or not guilty, the repercussions of taking a guilty plea and the repercussions of perjury on the part of the accused.

c) The ability/inability of an accused person to instruct and communicate with their lawyer e.g language barrier or being in and out of catatonic states or communicating vastly different instructions incase of schizophrenia or multiple personality disorders.e.g. Agreeing to take a plea bargain only to change when infront of a magistrate.

I believe the fitness hearing for Maribe is after a fortnight, you can get a feel of it, if it will not be in closed court
