Starting in 2018, Kenyans working in the diaspora must disclose their income to Kenya Revenue Authority or risk penalties. KRA has given until December 31st, 2017 for diaspora residents to file their returns for the year ended December 31, 2016. KRA will investigate those who will fail to report their earnings and issue heavy penalties after assessing their tax dues.

“We are asking these people to voluntarily come forward and take advantage of the tax amnesty. We are aware there are Kenyans holding assets overseas,” said the deputy commissioner in-charge of the policy and co-ordination unit at KRA James Ojee.

Those who will obey the order during the one year amnesty will have their taxes, interests, and penalties from past years up to 2016 waived.

Mr. Ojee told reporters that tax compliance in Kenya is very low with less than two million of the eligible ten million taxpayers complying.

To successfully finance the Ksh2.6 trillion budget in the 2017/2018 fiscal year, the government hopes to raise Ksh. 300 billion ($3billion) by taxing individuals, properties, and businesses owned by Kenyans abroad. Consultants, auditing firms, artists, footballers, and athletes are the authority’s major targets.

KRA said means of catching tax evaders will be gazetted. Cabinet Secretary for the National Treasury Henry Rotich already signed a multilateral tax information exchange agreement in Paris which allows 120 tax jurisdictions worldwide to share confidential information on individuals’ tax obligations.

“We are just waiting for the gazette notice. Once it is gazetted then we are up and running. This is going to form the basis for investigations,” said Mr Ojee. “Those who come forward will be happier than those who say let us wait and see.

Nonsense. You cant have a double taxation on the same income. Who in their right minds would voluntarily tell KRA what they earn abroad?

Right… The principles of double taxation reliefs for residents must apply.

Happens to US citizens, earn and get taxed at home or choose another country.

KRA is running out of ideas. And still guys will find a way out of this one. It would be interesting to find out how they intend to enforce the law. If I have a wholesale say in TZ does that mean the income I earn there must be declared to KRA yet I pay to TZ tax authoities?

If you meet any of the below you are a KE resident & therefore pay tax:

  1. Spends more than 183 days in a year in KE
    2.In three years average of 120 days(not sure) in KE
  2. Have a domicile in KE

Depends kama kuna double taxation treaties in place between governments. If Kenya doesn’t have double taxation treaty with country B, you pay full taxes to Kenya & country B. If Kenya has double taxation treaty with country C, you pay differential to Kenya

For US you need to show IRS that you have been paying income tax in the country you work in. Anything you pay thereafter is a small fraction of the whole.
My bro in germany was told by IRS he owes back taxes of like $17000.
He told them they are mad. He has been filing his returns to the IRS with all paperwork and pay the germans income tax.
There is a form in german that is attached to the IRS forms that the buggaz hadn’t looked at which declared his payments.
In the end they cancelled out that outstanding amount.

I have put three conditions up there that if you meet any of them you are automatically a Kenyan resident & therefore should file returns. Filing & paying is different. But you are right, kama pesa haifiki Kenya you can lie on income alafu unacheza chini.

Kabisa. Pig sty is a permanent home & you qualify to file returns. But the gray area is what is a permanent home? If your bro comes from majuu and stays with the folks, does he have a permanent home?
