Unbelievable really! He killed 2 people and literally got away with it. He was also drunk, drove for several kms with the girl on the roof of his car (without a leg which was ripped off) and tried to cover up the crime. 3 years for this?!

If the judge finds a person guilty, he can’t pull sentences from thin air. It is what the law prescribes.

The laws says imprisonment not exceeding 10 years when you cause death by driving.
Not exceeding 2 years when you are caught drunk driving.

The story changes if the good lady was crossing the road at an undesignated place. Why should the judge punish the driver for causing her death?
The driver can only be punished for drunk driving. And refusing to report an accident.

All you need in Kenya is billions and you are above the law.

Well I would think this are atleast 3 charges

i) DUI

ii)Vehicular Manslaughter - two counts since the woman was prego

iii) Concealing a crime

manslaughter, punishment sucks but hakuwa na motive premeditation

DUI is a 2 year jail time offense with option of Sh100,000 fine.
Failing to report a crime is a 6 month jail time offense, with option of a fine.

The only big crime here is manslaughter. And the law states a term not exceeding 10 years if found driving recklessly.

It is possible the guy was drunk but was not driving recklessly.
It is also possible (and I think this was the case) the girl was crossing the road where she was not supposed to be.
The lady put herself in danger.

Also, I saw that the lawyers are planning to appeal. They know the 3 years can actually be brought down.

He was driving wrecklessly, the video on cameras on Msa Road show clearly he had exceeded speed limits. I am also sure that fleeing a scene of crime is an offence in Kenya. Otherwise hit and run would not be a crime. Endangering life by not stopping to check if she was alive and take her to hospital. What is the law on hit and run.

Also what part of failing to report an accident don’t you understand. Hit and run falls under this part.

Failing to report an accident has a maximum sentence of 6 months or a fine of Sh10,000.
