  2. If the above is not true, what powers does the nullification take away from the incumbent?

  3. Is the the CJ not supposed to provide accurate interpretation of the constitution where ever there is a misunderstanding like now?

  4. In case of all the above fails, where do we run to?

The sitting President wields all instruments of power until another President is sworn in and power transfered. ALL. Let’s try another argument. The new constitution 2010 sets the presidential term at 5 years. UK was sworn in in 2013. When do 5 years expire ?

Today history has been made, since our independence, it has been a tradition for the Chief Justice and some selected Judges (nowadays Supreme Court) to attend the first opening of a New parliament. David Maraga is the first Chief Justice to skip this important event since kenya attained its independence. It’s an event where all Arms of Government met as a way of unity for the Kenyan people.

Now Maraga should tell us if that is the "GREATNESS of how he serves this country and his FIDELITY to the constitution with strict ADHERENCE to the rule of law. Above all does Maraga fear GOD!!!

Anyway apart from the ignorance of the threader, what would be the possible succession… Let’s say like today on the opening of parliaments the CIC, his deputy, the two speakers the CJ was to be there(whole team), with all government in one place… And the Fat boy from Korea mistakenly shots his nuke on the HOUSE! What is our possible Designate position. As in like the series movie, what’s our local position?

It is not his fault that he did not serve 5 years, blame it the previous regime for not being decisive enough to hold elections when they were due.
