And this is what Maraga Said Previously

Chief Justice David Maraga has questioned how
[U][I]
DPP Noordin Haji frames cases before taking them to court.

Maraga’s

statement comes a day after the DPP and DCI accused the Judiciary of leniency with suspects.

“Look at the way you frame cases. How can you put 30 accused persons in one charge sheet. And these 30 people are being represented by 30 lawyers,” he said.

“… how long do you think that will take?.. Those kind of cases will never move… let us speak the truth… find ways of how you frame your cases.”

Speaking during the Anti-Corruption Conference

at the Bomas of Kenya, Maraga said if the DPP does not solve these issues, cases will be stagnant.

So what next, we know the outcome already

Wafungwe, wasifungwe, I don’t care!

A few animals will forever be more equal than me.

Quite unfortunate.

Maraga is a fool.in cases like robbery with violence or theft have u ever seen them gangs charged in different charge sheets?

I think he was explaining why such cases take a long time

We need a Sharia law here in Kenia

but he didn’t need to advise that people who stole together in one crime be charged separately.

Did u even take time to understand my statement?have u seen a gang convicted individually?

Maraga doesn’t write charge sheets. Nor does the magistrate.

Those things are written by the DPP ie the Prosecutor.

U sir,are a fool

And you’re a fucking moron

I think the CJ was just explaining that the more the accused in a single charge sheet the more complex the case becomes in case of multiple lawyers on the same case, some lawyers take more time some work differently, thus the longer the time it takes to solve such cases.

Exactly

but he first criticised the way cases are framed.

what I am just elaborating is that the CJ was explaining why such cases take long time, the threshold for innocence or guilt is another matter, but I am assuming the more lawyers you have for a single case the more complex the case becomes, thus the longer time frames

I think he was responding to criticism that the judicially takes a long time on some cases and he explained the framing of the cases leads to longer periods due to the complexities involved, I don’t know what is the best procedure, but according to him its better to try as much as posible and have the cases as small as possible for speedier movement of the same, and I think it makes sense

Would it be feasible to have each suspect charged under their own charge sheet? That would mean 30 seperate cases, does the ODPP even have that kind of capacity? Would the Courts be able to handle all those cases? And why are these two agencies talking about each other instead of creating a platform where they talk to each other and find ways to streamline the process?

We need solutions not muddied waters.

why didnt he need to? they should be charged seperately. that way the cant all escape. charging them together is meant to ensure that the case stalls so that they can say the judge is the problem.

Imagine all lawyers asking for adjournment in sequence… Yaaani 1 lawyer this mentioning date, the other lawyer next mentioning date. True that case will drag immensely

yes these are grievous crimes akin to treason.
