Salary reduction Advice

Hi guys,
My employer, a large institution, has slashed our Basic pay significantly but curiously enough, left all the allowances intact. I have declined to sign this salary reduction agreement form on the grounds that basic salary should be the last option; not the first.

I’m I standing on a shaky ground or a solid one?

Given the prevailing economic times don’t know how wise that is , you might be the 1st people to be let go off, hope you have a rainy day nest egg

Some of the allowances are deductible so less tax to be paid hence saving money…this month has seen most employers filing Nil returns on their PAYE so you are lucky if you are still getting a salary.

Guys, I am not oblivious of the COVID-19 financial situation. I know pesa imepotea. What I asked is very simple. Many employees are for instance still drawing allowances for car, depreciation and responsibility when practically no travel and very little work is going on. Is it therefore FAIR, LEGAL and JUST to chop Basic salaries and be blind to all these other options?

Is the reduction in basic salary greater than total allowances? Is that why you’re unhappy? If it isn’t then just sign the paperwork and max out the allowances. Like you’ve been advised hapo juu, only you know how indispensable you are to the institution. Can you find another job of the same caliber if they dismiss you for non compliance?

A reduction in basic pay will apply to all employees as opposed to a reduction of allowances which may apply to a few employees
However such decisions are taken at that discretion of management. At this time, if you fail to sign, you could be easily sent home without benefits

Do you know if they were required to sign anywhere? Or it was an administrative fiat…

Contract law allows parties to alter terms or terminate a contract once a frustrating event occurs.
Well, companies are being advised to unilaterally alter contracts by reducing salaries or fire employees who do not take the cut. We figure that even if an employee sues, it’ll take time before a court determines otherwise.

Shouldn’t that reduction be done WITHIN the law and common sense;

For instance, if a payrol is say, 7M and;

  1. An organization can save 5 M from cutting travel allowances; 2M from cuttting 5% or Basic salary. Or;
  2. 7M from cutting 40% of Basic salary

Does the law allow the employer an arbitrary choice? This is because it is my understanding that while allowances are fairly fluid, basic pay is a little more sacred and should be touched as the last resort…

I know. I am usually a stickler. I just don’t like people using power and situations to “kanyaga watu”. And I don’t like fatalism. Many people just urge me to obey because millions have lost jobs. I am very prepared to obey mandates grounded in a sense of law and justice. Sounds idealist and out of touch; but that is me:) By the way the position I am taking may not benefit me much but it will benefit many lower cadre staff who lack much of these allowances and therefore will be left severely exposed. I know it is unjust. What I don’t know is whether it is illegal.
