Supreme Court turns away petitioner

[I]One Juma Kenyatta-Awori Marie has sought to file a petition in the Supreme Court with relation to the election but has been turned away/FILE

NAIROBI, Kenya, Aug 18 – As all eyes are trained on the petition the National Super Alliance has promised to file in the Supreme Court this afternoon challenging President Uhuru Kenyatta’s re-election, it has emerged that another party has raised issues on the exercise.

One Juma Kenyatta-Awori Marie has sought to file a petition in the Supreme Court with relation to the election but has been turned away.

The Deputy Registrar in the Supreme Court Daniel Ole Keiwua says Marie’s document has been rejected for the reason that it raises bill of rights concerns and doesn’t directly challenge the outcome of the presidential petition.[/I]

[I]“The petition is to deal with a question as to the validity of Presidential election. The document before me does not articulate that as an issue. It appears to seek for declaration of certain fundamental rights, a jurisdiction of the High Court,” Keiwua stated in his ruling.

The issues raised in Marie’s document relate to the rights and freedoms of persons suspected to be criminally insane, entrapment of a president, treason and conspiracy to commit treason.

The document which lists Wafula Chebukati, Raila Odinga, Uhuru Kenyatta and Babu Owino as among the respondents, Ole Keiwua explained, was also rejected for lacking the support of an affidavit.
