The Thunderbolt thrown into a 2 second election

Greetings to all my brothers, sisters, sons’ daughters, mum\dad and grand & great parents as well. I am new to KenyaTalk and this is my first post.

The way one sees it, neither Jubilee nor NASA has made any mistakes. The history of elections in Kenya has never been straight forward rigging and malpractice the norm for many years. It is therefore unlikely for any leader to consent defeat even when the loss is legitimate.

A Thunderbolt of immense strength has been thrown into the Kenyan political arena, to change the course of political discourse or destroy it. There will only be two outcomes one of which will silence either side and allow Kenyans to move a step forward, with a Judiciary that is stronger and more trusted.

If the malpractices significantly benefited Jubilee then they will lose, However if it did not they will win with an expanded margin of votes. It is not the core voters that decide election outcomes it is always the undecided voters that have the final say when elections are free of malpractices. If these group of voters’ votes as one might guess did in August…. then the outcome of the next election is probably conclusive.

This can only apply when we have a judiciary that is honest. Maraga didn’t care to tell the IEBC what they need to change, he just said they should follow the law, yet they have to conduct another election within 60 days. Maraga is now having a sweet time resting waiting for IEBC repeat the same ‘mistakes’ if at all there were any. This nigga is pulling a bensuda move, misusing court to drive his political agenda.

The Judiciary is not the Voter.
In nullifying the elections, the chief justice gave a reason…

Chief Justice David Maraga agreed together with Deputy Chief Justice Philomena Mwilu, Smokin Wanjala and Isaac Lenaola that the electoral body messed up transmission of poll results.
“A decision is hereby issued that the elections held on August 8, were not conducted in accordance with the Constitution and the applicable law. The results are therefore invalid, null and void,” Chief justice David Maraga said.

What if he ordered a re-count… We have the ballots… We know the number of voters… And then ask the first respondent to cater for the cost

If it was the transmission, them the wise thing was to call all 34A and do a recount. There is no justification for calling another election if it was all about transmission. We the voters also have a right, we spent money and the whole day to vote, why take us back there when the votes casted are still intact. What about the country economy? Maraga will be judged harshly by history

The chief justice further elaborated……

“A decision is hereby issued that the elections held on August 8, were not conducted in accordance with the Constitution and the applicable law. The results are therefore invalid, null and void,” Chief justice David Maraga said.
“Elections is not an event but a process. After considering the totality of the entire evidence, we are satisfied that the elections were not conducted in accordance to the dictates of the Constitution and the applicable principles.”

Vote count on its own is an event. Voting, counting, declaration, transmission, ballot paper handling etc. cumulatively are a process, when either of these is broken then the process is in breach of the constitution and the applicable law.
If the process is corrected i.e. the transmission no one can complain about the possibility of being cheated out of a win. Rectifying the process may or may not impact the total vote count.
