HOW DOES DEEP STATE HOPE TO AVOID A REFERENDUM?
This is the crux of the Advisory.
So, a committee has sat within the Deep State and concluded you actually do not need a referendum to adopt the BBI.
Referendum, through a Popular Initiative only happens if…
A) Bill is NOT passed
or
B) There is a 255 (1) issue (See attached)
So how is a bill NOT passed?
Majority of the members in both houses. So it is simple majority of all the membership of the house.
Essentually 50+1

The other path to a Referendum is…If 255 (1) is NOT impacted.
That is the patg Deep State and System is banking on.
Question? Who decides it is NOT impacted?
Largely, the constitution is Not express, therefore leaving the decision to the Executive.
The idea is to have BBI passed in both houses
Once that is done the President, will refer the bill to The Attorney General for a legal opinion on whether any part of 255 (1) is impacted.
Do you need to wait for AG opinion?
No.
Because HNIB has a sneak preview
He will argue only the protected provisoonsin the bill of rights to Privacy are impacted via the Data ammendment.
That needs a Referendum.
That referendum question on data should not cost the Country Shs. 15b.
So, the rest of the BBI will be signed into law and that small bit will be the 7th ballot in the 2022 General Elections.

ruBBIsh is very unpopular. Some ratings have it at 19% some at 11%. To give hope for the state actors who commissioned the survey then they have put 20-25% as undecided but to be frank the 11% in favour is accurate. So this was summed up to say even if they get DP Uncle Ruto to support it they still have no guarantee it will pass in a referendum.
The dynasties and RAT are basing their popularities on some vague numbers. A referendum now will make everyone true numbers visible. President Uhuru knows he has been totally replaced in central and Mt. Kenya. However a referendum will clearly show the numbers against him at his former base and the whole country. Rigging is out of the question. We ran an open elections with many ears and eyes overlapping every step of the way. As we have been vigilant in securing our votes in by elections where the state had few centres to manipulate. Now imagine trying to do that in 36,000 polling stations simultaneously. Basically a referendum now will greatly embarrass President Uhuru, handcheque and RAT. It will end his reign before time.
ruBBIish needs referendum as it is now. It changes the composition of our executive. Junior PM, judiciary ombudsman and increased members in senate/parliament. There is no going around that.
The court, even bought court can’t suddenly change our current constitution to allow ruBBIsh to pass through the backdoor. That will be a grossly dangerous thing to do that can break the Republic. Here NIS advise need to be followed. Don’t shake the foundations of the republic for personal political gain.
Finally President Uhuru has accepted he doesn’t have the funds to finance ruBBIsh campaigns countrywide, nor the desire and also state finances for it. IMF bailout that saved this government has forced government hand in its expenditure going forward. A national political quest will not be accepted. IMF money is not paid in wholesome. Its in tranches depending on Treasury maintaining fiscal policies they have agreed with IMF.
So what is the end game now.
President Uhuru wants out of ruBBIsh with an excuse. It will go to Parliament and senate. The good provisions of it will pass that don’t need a referendum. Simple acts of Parliament and some by administrative changes from the President. Things I here and many others said from the start. The very unfavourable provision of this ruBBIsh do indeed need a referendum. Once the good have passed then the bad ones will remain and it will make ruBBIsh very unpopular. Only Christ will be able to make it pass. I suspect after Parliament passes what it can, then the rest will be delayed indefinitely maybe to 2022 alongside the general elections.
Hii ujinga ingine that they can pass it wholly through parliament and senate only is stupid and lunatic. The current constitution is very clear how you can amend it and a letter from AG saying otherwise or a paid court ruling is void and invalid.
