What is the purpose of mental assessment of suspects in Kenya?

We have been seeing mental assessment of suspects from Major Mugure to Naivasha mom who killed her 4 kids to the boy who killed his family. For the Naivasha mom, the psychiatrist said she was not OK mentally but she was still expected to take a plea. What exactly is the point of this assessment if at all suspects will go to court even when they are assessed to be mentally ill and what are the parameters that differentiate the mentally unwell person from the one fit to stand trial or is it just a formality like every thing else in Kenya? If you are assessed to be insane do you go to a hospital like mathare or you are still remanded in jail?

If you are mentally ill, legally you cant make decisions. Including taking a plea. My guess is that the trial will still take place but you are separated at Kamiti.

How would a trial proceed when the accused is incapable of taking a plea?

An appointed team will take it for him. A trial has to take place because you have to find him guilty to confine him.

My question was, what exactly is the point of having a mental assessment if at all the trial will just proceed as usual even when the defendant is not fit to stand trial by reason of insanity?

For example, the Naivasha mother was evaluated and found to be insane and she still took a plea and she is in remand with sane people instead of being taken to mathare for treatment

Even more famous is the attempted assasin of President Ronald Regan who was found not guilty by insanity.

What happens in cases of temporary insanity, delusion or hallucinations caused by say drugs. I see alot of beheading cannibalism and decapitation from people having a bad trip from PCP

How about if you didn’t know what you were taking. Like if you thought you were smoking a regular blunt but it was a wet blunt or it was laced with PCP. I saw a case where a guy bought a blunt and after he smoked it he shot his entire family, his defense was that he was given a bad blunt it wasn’t what he usually had

Its the last episode of season 1 I am a killer. He shot his whole family after he smoked a spiked blunt.

On November 7th 2000, Deandre Buchanan was arrested near the scene of a triple homicide. Angela Brown, the mother of Buchanan’s two infant daughters, his stepfather and his aunt, had all been shot dead by Buchanan. In a recorded police interview, Buchanan claimed he had smoked a joint which had been laced with an unknown drug and that he had subsequently become convinced that everybody at the party were attempting to kill him. Buchanan is currently serving a life sentence, although he is actively trying to appeal his case with the hope of being given a reduced sentence. He maintains he was intoxicated at the time of the murder and not in his right mind.
