Maraga did the right thing and it shows that our Judiciary has reached a desired level of maturity where they can decide a case in favor of the constitution as opposed to bending backwards to the will of the powers that be. Repeating the entire election would require the government cough up another Ksh 60 billion which will come in form of more taxes. But you will still see some monkeys (sub specie Kenyans) supporting the idea and then complain that life has become expensive

I think this is genius by Martha and would favor the RWNEBP camp if she was to be granted her prayers!

All elected persons will reject a court decision that invalidates their position and their trappings, and will fight to the SC to prevent fresh elections. That way, Maraga and the gang will have to uphold the initial elections and be left with egg fuckfaces.

If they order fresh national elections, they will be hunted by a combination of the Wa Njokis the mashinani MCAs to the Orengos, the national figures, and they donā€™t want that given this current experience.

For the other 5 positions,MCA, MP, Women Rep, Senator and Governor, are the results announced at the grassroots, or, at the National tallying center ?

Agreedā€¦but remember that SCOK only has jurisdiction over the presidential elections. Izo zingine are dealt with by other courts.
Nullification is a viable option given that there are already 277 petitions in our courts

Thereā€™s presidential returning officer who is the iEBC chair, then county RO for countywide seats then constituency RO for MP and MCA.

How viable is Karua petition, if the Presidential election was nullified mainly on transmission, to the tallying center.

The first High Court Judge that will rule on a petition based on the SCOK finding will set precedence, I guessā€¦cc @Nananimpa , @Ndingoo wa Ingoo

Not possibleā€¦This is why: each case is dealt with based on facts and evidence presented and is unique. The presidential petition touched on Presidential vote only. When people say that Maraga should have considered MCA and governors electionsā€¦judges cannot become the petitioner/complainant. She should file specifically targeting the county she vied in. Plus MPs have already been sworn in na parliament ishaanza biznaā€¦overturning all that si kazi ya Judiciary sasa. She is a lawyer anafaa ajue ii yoteā€¦

The law is, you cannot seek for orders to nullify the entire election. The election laws require the Petitioner to have been aggrieved personally and to demonstrate to court that the election process was conducted to her/his detriment. The SCOK was approached by Raila and Kalonzo and they demonstrated that the process was not free, fair, transparent and accountable. Martha is attempting to force the Election Court to usurp jurisdiction not provided inthe laws and look into how the process affected all candidates vying for all the positions without those candidates coming to Court to invoke that jurisdiction. It is not possibleā€¦
