Hapa shida si judiciary, ni parliament. If they wanted to, they could propose a bill for tougher sentences lakini hawawezi ju ni wao watafungwa. Judiciary is only implementing laws made by parliament.

Kuiba ni theft, hii inakaa embezzlement na fraud which has a different sentence. Anyway @Vadim knows more about this stuff. I remember asking him the same question and he answered that judges follow a rule book when deciding such sentences. Hapana, you are mixing issues and different cases. Gwendo was fined 1 million for giving a bouncing cheque for goods and services delivered. She entered a plead deal to accept liability, pay the amount and court fine. She failed to honour that plea and was sentenced on both counts.
This other case is a corruption case where you can serve 5-10 years just like the former Tourism Fund director. That’s why the fine looks very suspicious and that’s why Hajj is appealing.

Truth is, nobody has been sentenced to more than 5 years for corruption and if they did, they’ve been offered an option to pay a fine. It has something to do with a law or a bill in the constitution. Just google selisio karanja utapata all the news.

That’s asset recovery unit mandate not AG. The AG powers were slashed to minimal by this constitution thanks to activists. He is just the government lawyer. Even the Solicitor General signs legal documents on behalf of government not AG. The AG only drafts legal government documents/bills, gives legal opinions and represents government in court. The OPP handles prosecution independently and Solicitor General signs legal notices that the AG presents to President Uhuru, they are approved and signed.

Fraud and corruption cases are charged under Economic crimes laws not penal code.
