This election was stopped on a technicality. IEBC was mandated to provide a fair election in ALL regards. It failed. Transmission of results is equally important to the tallying of results. I must say that NASA did not really present a strong case but the judges decided to showcase their judicial might instead. Its not about Maraga. One of Justice Njokis dissenting arguments ( in her statement) was that the observers deemed the election fair and credible. But the observers are not mandated or regulated by the constitution. Neither are their standards to pass judgement. Her arguments fall outside judicial jurisdiction.
Was the election credible and fair? I say yes. Was the election perfect? No way near. But the further away you fall outside perfection, the higher the likelihood of one of the contenders rigging the election. This time, the courts decided to control how far you can fall away from perfection.
